Headnotes

  1. Civil Procedure — Perfecting an Appeal Where the term at which an appeal is returnable passes without the record being filed, the appeal loses its force, and a second appeal may be taken if the time for taking an appeal has not yet expired. 134 U.S. at 332
  2. Civil Procedure — Filing the Record Where an appellee does not exercise the right under the ninth rule to docket the case and dismiss the appeal for the appellant's failure to docket the cause and file the record, the appellant may file the record at any time during the return term. 134 U.S. at 332–333
  3. Civil Procedure — Jurisdiction Neither the signing of a citation nor the approval of an appeal bond is essential to the appellate court's jurisdiction; what is essential is that the transcript of the record be filed during the term at which the appeal is returnable. Accordingly, the failure to obtain a citation or give a bond within two years of the rendition of the decree does not deprive the court of jurisdiction where the transcript is filed during the term succeeding the allowance of the appeal. 134 U.S. at 332–333
