Headnotes

  1. Constitutional Law — Commerce Clause A state privilege tax imposed upon a sleeping and palace car company for carrying passengers from one point to another within the state is not invalid as an interference with interstate commerce where the company is free to abandon the local business taxed; a company cannot complain of being taxed for the privilege of doing a local business which it is free to renounce. 189 U.S. at 422
  2. Constitutional Law — State Taxation — Compelled Local Business If a state constitution obligated a sleeping car company to carry local passengers — a burden imposed by law and not freely assumed — a privilege tax on that local business, in combination with the obligation, would impose an unconstitutional burden on interstate commerce analogous to a requirement that a foreign corporation submit to taxation as a condition of doing interstate business. 189 U.S. at 422
  3. Constitutional Law — State Taxation — Privilege Tax Because the validity of a privilege tax on local carriage turns on whether the taxed business is obligatory under the state constitution, the taxpayer is entitled to a determination of how it stands under that constitutional provision, and a judgment sustaining the tax cannot rest on reasoning that leaves that question obscure. 189 U.S. at 423
