Headnotes

  1. Tax Law — Estate Tax A conveyance of securities made before the grantor's death, not in contemplation of death, in trust to accumulate income until a distant date and then to divide the fund among beneficiaries designated by name, vests the beneficiaries' interests when the trust is executed and is not a transfer "intended to take effect in possession or enjoyment at or after his death" within the meaning of § 402(c) of the Revenue Act of 1918. 273 U.S. at 547
  2. Tax Law — Estate Tax Where a trust has no reference to the grantor's death and operates the same whether he lives or dies, and the beneficiaries' interests vest upon execution of the instrument even though they may be divested upon a beneficiary's death before termination of the trust, the transfer is not one intended to take effect in possession or enjoyment at or after the grantor's death. 273 U.S. at 547
  3. Tax Law — Estate Tax Where a grantor parts with all his interest in property to other persons in trust, without any thought of avoiding taxes, the fact that income vested in the beneficiaries is to be accumulated for them rather than distributed to them for immediate spending does not render the trust one intended to take effect in possession or enjoyment at or after the grantor's death. 273 U.S. at 547-548
