Headnotes

  1. Constitutional Law — Due Process A state statute making a bank director individually liable for deposits received by the bank with his assent while it was insolvent, and providing that proof of the bank's insolvency shall be prima facie evidence of the director's knowledge of the insolvency and assent to the deposits, does not deny due process of law. 277 U.S. at 94
  2. Constitutional Law — Due Process A state may lawfully impose personal liability on bank directors to depositors for every deposit accepted while the bank is insolvent; a director who accepts the office assumes the risk of the liability the statute imposes, and the statute remains valid when it imposes a liability less extensive than the state could otherwise have required. 277 U.S. at 94
  3. Constitutional Law — Due Process A statute that charges a bank director with knowledge of the bank's insolvency based on his failure to examine the bank's affairs, and with assent to deposits received while the bank remained open, does not violate due process, because the state could have made directors liable in every case and the director assumed the risk of the statute's terms upon accepting office. 277 U.S. at 94
