LAY, Chief Judge. Fred L. Pletka, an inmate at the Iowa State Penitentiary, appeals the district court’s 1 order denying his claim for damages resulting from prison officials' alleged violation of his rights under the due process clause. Pletka was under punitive segregation in Iowa when he was transferred to the Texas prison system and released into the general population. The district court found that Pletka’s due process rights were violated when he was transferred back to Iowa and was returned to punitive segregation without a hearing.
