Headnotes

  1. Civil Procedure — Notice of Appeal as Application for Allowance Where a notice of appeal is filed with the clerk of the district court within the three-month period prescribed by § 8(c) of the Act of February 13, 1925, and the intention to appeal is apparent, the district court has discretion to treat the notice of appeal as an application for allowance of the appeal; only a formal request is lacking in such circumstances, and the court's exercise of that discretion is not an abuse where the notice was properly filed and the intent to appeal was clear. 323 U.S. at 336
  2. Civil Procedure — Timeliness of Allowance Where an appeal statute merely requires that an application for an appeal be made within the prescribed time, the allowance of the appeal may be granted subsequently; the appellant's right to appeal is not defeated by the timing of the court's allowance where a timely application has been made. 323 U.S. at 337
